Terms of Service

These Terms of Service ("Terms") govern your use of surethemez.com and the purchase of any digital products ("Themes") from Sure Themes ("we", "us", "our"). By accessing the site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into contracts to purchase from us.

2. Products

We sell digital Shopify theme files. Product descriptions, screenshots, and demos are provided in good faith but may vary slightly from the delivered file due to ongoing improvements.

3. Orders & payment

All prices are listed in CAD unless otherwise noted. Payment is due at checkout. We reserve the right to refuse or cancel any order, including for suspected fraud or pricing errors.

4. License & use

When you purchase a Theme, you receive a limited, non-exclusive, non-transferable license to install and use that Theme on one Shopify store. You do not receive ownership of the intellectual property in the Theme. Full license terms are set out in our Theme License. You may not resell, redistribute, or sublicense the theme file.

5. Delivery

Themes are delivered digitally by email immediately after payment is confirmed. See our Delivery Policy for details. We do not ship physical goods.

6. Refunds

Refund eligibility is set out in our Refund Policy.

7. Lifetime theme updates

Every Theme purchase includes lifetime access to updates for the Theme you purchased. When we release improvements, bug fixes, compatibility updates, or new features for that Theme, you continue to receive the latest version at no additional charge. Lifetime updates apply to the Sure Themes Theme product itself; they do not include ongoing modifications, maintenance, or custom development for your individual Shopify store.

8. Developer support

Every Theme purchase includes 30 days of developer support from the date of purchase. Support includes theme installation, initial setup, questions about built-in features, troubleshooting issues related to the original Theme, and guidance configuring available Theme sections and settings. Support does not include building new custom features, extensive redesigns, third-party app customization, custom coding unrelated to the original Theme, or ongoing store management. After 30 days, store-specific work is available as a paid service.

9. Custom development & maintenance

Custom development (new sections, design changes, integrations, bespoke coding) and ongoing maintenance of your individual Shopify store are paid services, separate from lifetime Theme updates and from included developer support.

10. Intellectual property

All themes, code, images, text, and branding on this site are the property of Sure Themes or its licensors and are protected by copyright and other laws. Purchasing a Theme grants a license, not ownership.

11. Prohibited use

You agree not to (a) copy, resell, or redistribute the Theme; (b) remove copyright notices; (c) use the Theme for anything unlawful; or (d) attempt to disrupt or reverse-engineer our systems.

12. Disclaimer & limitation of liability

Themes are provided "as is" without warranty of any kind. Sure Themes does not guarantee any specific business outcome, conversion rate, search-engine ranking, page-speed score, or increase in sales resulting from installing or using a Theme. To the maximum extent permitted by law, Sure Themes will not be liable for any indirect, incidental, or consequential damages, including lost profits or data loss, arising from use of the themes or the site. Our total liability for any claim will not exceed the amount you paid for the Theme in question.

13. Third-party services

The site uses Shopify and may link to third-party services. We are not responsible for the content or policies of those services.

14. Termination

We may suspend or terminate your access if you breach these Terms. Sections that by their nature survive termination (IP, liability, license restrictions) will continue to apply.

15. Governing law

These Terms are governed by the laws of Canada and the province in which Sure Themes is established, without regard to conflict-of-laws principles.

16. Changes

We may update these Terms from time to time. The "Last updated" date will reflect any changes.
